Camas-Washougal Municipal Court

Dissolution Process for Camas Residents

Camas residents file for dissolution under RCW Chapter 26.09. Washington is a no-fault state. The only ground for dissolution is that the marriage is "irretrievably broken." Under RCW 26.09.030, at least one spouse must be a Washington resident or an armed forces member stationed here at the time of filing. No minimum county residency period applies.

You start by filing a Petition for Dissolution and a Summons at the Clark County Superior Court. The other spouse must be served with the papers. Both spouses can agree on all terms and file an agreed decree, which tends to move faster. If there are disagreements about property, debts, or children, the case may need mediation or a court hearing before a judge signs the decree. Washington requires a 90-day waiting period from service before the dissolution can be finalized.

The Clark County Family Court Facilitator is on the first floor of the Clark County Courthouse. You schedule a 20-minute appointment by going to the clerk's counter in person. Phone scheduling is not available. A $20.00 user fee must be paid before the appointment. Appointments run from 1:00 p.m. to 3:30 p.m. The facilitator can review your completed forms for procedural correctness and explain court procedures. They cannot fill out forms, give legal advice, or assist people who are represented by an attorney.

Form packets are available for purchase at the Clark County Clerk's Office or Law Library. Dissolution with children costs $50.00 and without children costs $30.00. All forms are also available free at courts.wa.gov/forms.

Divorce Certificates vs. Decrees

There are two different types of documents related to a completed divorce in Washington. A divorce decree is the full court order that explains all the terms of the dissolution. It can be many pages long. You get the decree from the Clark County Superior Court Clerk. The Department of Health does not have it.

A divorce certificate is a shorter document also known as a certificate of dissolution. The Washington State Department of Health issues these after receiving the record from the county clerk. The DOH holds certificates from 1968 to the present. Fees start at $25 per copy. It can take up to five months after a divorce for the county to send the record to the DOH. If your case is recent, contact the Clark County Clerk first to check whether the record has been sent.
